I have started here on 14,3 (c). I don't really have any substantive comments. In my view, the main elements are there. On a general note I would suggest that the an English editor has a quite look but I guess you will do this for the entire tool at a later date - as some tweeking would impove the text in parts. For example instead of &quot;retard&quot; you could say something like &quot;....if trial proceedings are delayed&quot;.<br \/>\n<br \/>\nI would also reword the third para of the main text as the first line is not very clear to me nor its relationship with the rest of the paragraph. I am talking about the line &quot;The elements of ....&quot;<br \/>\n<br \/>\nIn the last para of the main text the first and last lines could be reworded.<br \/>\n<br \/>\nYou may want to add a reference to article 9 (3) of the ICCPR which in cases of detention overlaps with 14,3 (c). I looked but it doesn't appear that this right (9,3) has been completed yet for a similar cross-reference.","replyPages":[{"page":0,"digests":[{"id":"40685585","body":"Speaking of cross-referencing, we should add a note that (only) in death penalty cases undue delay can rise in severity from a fair trial problem to an inhuman treatment\/punishment issue.<br \/>\n<br \/>\nThat the time count normally starts with a charge seems clear. But can the length of the procedure also become excessive if a suspect is arrested too early, before strong evidence is available? It is a fairly common scenario that over-zealous authorities throw people in detention first, then start putting together the charge slowly and (much) later.<br \/>\n<br \/>\nShould we include an opinion on what the consequence is of excessive delay? (Compensation?
