What is sexual violence?

According to WHO, sexual violence is: ‘any sexual act, attempt to obtain a sexual act, unwanted sexual comments or advances, or acts to traffic, or otherwise directed against a person’s sexuality using coercion, by any person regardless of their relationship to the victim, in any setting’.

When is it an international crime?

In addition to being a crime in most national legal systems, sexual violence is also a violation of human rights and, in situations of armed conflict or occupation, a violation of international humanitarian law. The statutes and case law of the International Tribunals for the Former Yugoslavia and Rwanda, the Special Court for Sierra Leone, the Extraordinary Chambers in the Courts of Cambodia, and the ICC Rome Statute, when taken collectively, define sexual violence to encompass: rape, sexual slavery, forced prostitution, forced pregnancy, enforced sterilization and any other form of sexual violence of comparable gravity, which may include indecent assault, trafficking, inappropriate medical examinations and strip searches.
As Madeleine pointed out, it would be useful to have an explanation of which rights are violated by when.

When would a sexual violation committed by a private individual qualify as human rights violation?

Contextualization of a certain degree to describe when sexual violation amounts not just a crime but human rights violation would be useful.
We would like to share some general comments on the issue and we are willing to broaden our input with further foundations from International Human Rights Law.

We consider sexual violence a serious violation of personal integrity that is manifested through a number of heterogonous acts that allow for their classification according to their gravity.

Likewise, besides the elements established in the comprehensive definition outlined in this wikispace, we consider it important to make explicit the relationship between this form of violence and the right to personal integrity and in this way specify the circumstances in which sexual violence can be a form of torture or cruel, degrading or inhuman treatment, as would be the case of forced nudity with the objective of humiliating the victim.

In relation to the condensed definition, we consider it relevant to also include the reference to the different levels of gravity of sexual violence.

We consider sexual violence as an affectation to personal integrity that must be analyzed from a gender-based perspective. In this sense it is worth noting, inter alia, the patriarchal control of feminine sexuality, social and State permissiveness towards pornography that stereotypes the role of the women in sexual acts and the express recognition that all forms of sexual violence are forms of discrimination against women. We consider it very important to emphasize this point that social and cultural tolerance towards sexual violence and impunity are factors that contribute to the fact that this violence is maintained.
