\nIn the condensed version, the following sentence should be nuanced as for now it is confusing:'The state has the obligation to ensure access to adequate housing generally, and in particular, alternative shelter for the illegal occupiers, thus protecting against the violation of the right to property.' This sentence does not apply to conflict situations, whereby illegal occupation or destruction of property is part of the war strategy and thus should not result in a State obligation to provide alternative housing to the occupiers, to the contrary!
\n
\nIn the comprehensive version, reference should be made to the Pinheiro Principles - at present, reference is only to the preliminary report presented by S. Pinheiro to the sub-commission. Reference should be made to the Principle on secondary occupancy but also to the primary principle of a right to property restitution in case of arbitrary occupation\/destruction.","replyPages":[{"page":0,"digests":[],"more":0}]}],"more":false},"comments":[{"id":"41689109","dateCreated":"1314353391","smartDate":"Aug 26, 2011","userCreated":{"username":"cristinamichels","url":"https:\/\/www.wikispaces.com\/user\/view\/cristinamichels","imageUrl":"https:\/\/www.wikispaces.com\/i\/user_none_lg.jpg"},"monitored":false,"locked":false,"links":{"self":"https:\/\/ohchrglossary.wikispaces.com\/share\/view\/41689109"},"dateDigested":1532174767,"commentId":"820459","orphaned":false,"startDate":null,"sharedType":"comment","title":"Comment: this is a useful clarification that s...","description":"this is a useful clarification that should also appear in the condensed entry","rangeActions":[{"name":"Comment added","rangeText":"The difference between expropriation and confiscation is the motivation for the taking of property.","dateCreated":"1314353391","user":{"username":"cristinamichels","url":"https:\/\/www.wikispaces.com\/user\/view\/cristinamichels","imageUrl":"https:\/\/www.wikispaces.com\/i\/user_none_lg.jpg"},"diffUrl":"\/page\/diff\/Illegal+confiscation%2C+occupation+or+destruction+of+property\/248599969?mode=code"}],"replyPages":[{"page":0,"digests":[],"more":0}]}]},"http":{"code":200,"status":"OK"},"redirectUrl":null,"javascript":null,"notices":{"warning":[],"error":[],"info":[],"success":[]}}
