I have thus added mention of main elements of forced evictions (arbitrariness, coercion, etc) as a conceptual help. (See also booklet done by OHCHR Cambodia office to explain forced eviction in Cambodian context).
\n
\nIn the comprehensive definition, reference is made to development based evictions (or 'removal' as it is termed here), as well as conflict-based. The current paragraph is confusing and adds new terminology and distinctions that are not that helpful. Perhaps one could simply add one line that evictions or displacement can take place within the context of development, as well as conflicts, post-conflict, or post-disaster settings, with the obligations to abide by the same procedural safeguards as for any other eviction. Here make reference to the Basic Guidelines and Principles on Eviction and Displacement (which Bahram suggested already). One could also note that in the context of armed conflict, additional requirements and legal obligations apply.
\n
\nI would also suggest that one should refrain from legalistic references, but try to make it as practical as possible for field presences and non-lawyers. For instance the last paragraph on HRC\/ECtHR cases might not be that useful. The main point here is that bodies other than CESCR have dealt with the issue of forced evictions, highlighting that it is a violation not only of the right to adequate housing but also of other civil and political rights.","replyPages":[{"page":0,"digests":[],"more":0}]}],"more":false},"comments":[{"id":"41691425","dateCreated":"1314364632","smartDate":"Aug 26, 2011","userCreated":{"username":"cristinamichels","url":"https:\/\/www.wikispaces.com\/user\/view\/cristinamichels","imageUrl":"https:\/\/www.wikispaces.com\/i\/user_none_lg.jpg"},"monitored":false,"locked":false,"links":{"self":"https:\/\/ohchrglossary.wikispaces.com\/share\/view\/41691425"},"dateDigested":1532174690,"commentId":"319985","orphaned":false,"startDate":null,"sharedType":"comment","title":"Comment: comment by lcourdesse: \nWHY ARE THESE...","description":"comment by lcourdesse:
