Comments function was not working, so I am posting as a comment.

The addition to go to the last part of the comprehensive section:

The WGEID has defined enforced disappearance as a ‘continuous crime’ which begins at the time of the abduction and extends until the State acknowledges the detention or releases information pertaining to the fate and whereabouts of the individual. [General Comment on Enforced disappearance as a continuous crime. Available at: (http://www.ohchr.org/Documents/Issues/Disappearances/GC-EDCC.pdf)]

On the other hand, victims’ right to know the truth in relation to enforced disappearances entails:

a) The right to know about the progress and results of the investigations;

b) The right to know the fate or whereabouts of the disappeared persons; and

c) The right to know the circumstances of the disappearance and the identity of the perpetrator(s). [General Comment on the Right to the Truth in Relation to Enforced Disappearances. (c) by agents of the State (or political organization) - to make it clear that two actions by one agent.

[2] Would it be possible to include some kind of definition of what would qualify as "political organizaiton".

[3] 3 elements requirements by the working group seems to be repetitive with the definition of the convention and not necessary.
For the condensed section I would use the definition given by the specific international binding instrument (i.e. the Convention on Enforced Disappearances). The definition given by the Rome Statute, only for crimes against humanity, will be anyway reflected later.

I would draft the second para. of the condensed section as follows:

The state has a duty to investigate allegations of enforced disappearances for as long as the fate and whereabouts of the disappeared person remain unknown.
I would not list ED under right to life. The right to life can or cannot be violated (it depends on the situation – see e.g. art. 1.2 of the UN Declaration on Enforced Disappearances).

I would rather create a new category given the many specificities of this crime (see article 1.2 of the UN Declaration on ED; in addition, since 1995, the Working Group has clarified that States are not bound to strictly follow the definition of the offence as contained in the Declaration, ensuring however “that the act of enforced disappearance is defined in a way which clearly distinguishes it from related offences such as enforced deprivation of liberty, abduction, kidnapping, incommunicado detention, etc.).
